General information on data processing
Scope of the pro¬≠ces¬≠sing of per¬≠so¬≠nal data

In the fol¬≠lowing, we inform you about the collec¬≠tion of per¬≠so¬≠nal data when using our web¬≠site. Personal data is all data that can be rela¬≠ted to you per¬≠so¬≠nal¬≠ly, such as name, address, e‚ÄĎmail address or user beha¬≠vi¬≠or. These and other defi¬≠ni¬≠ti¬≠ons of the General Data Protection Regulation can be found here.

As a matter of principle, we collect and use personal data of our users only to the extent necessary to provide a functional website and our content and services. The collection and use of personal data of our users is regularly only carried out with the consent of the user. An exception applies, for example, in those cases where it is not possible to obtain prior consent for factual reasons and the processing of the data is permitted by legal regulations.

Legal basis for the pro¬≠ces¬≠sing of per¬≠so¬≠nal data

Insofar as we obtain the con¬≠sent of the data sub¬≠ject for pro¬≠ces¬≠sing ope¬≠ra¬≠ti¬≠ons invol¬≠ving per¬≠so¬≠nal data, Article 6 (1) (a) of the EU General Data Protection Regulation (GDPR) ser¬≠ves as the legal basis for the pro¬≠ces¬≠sing of per¬≠so¬≠nal data.

When processing personal data that is necessary for the performance of a contract to which the data subject is a party, Art. 6 (1) (b) DSGVO serves as the legal basis. This also applies to processing operations that are necessary for the performance of pre-contractual measures.

Insofar as pro¬≠ces¬≠sing of per¬≠so¬≠nal data is necessa¬≠ry for the ful¬≠fill¬≠ment of a legal obli¬≠ga¬≠ti¬≠on to which our com¬≠pa¬≠ny is sub¬≠ject, Art. 6 (1) lit. c DSGVO ser¬≠ves as the legal basis.

In the event that vital inte¬≠rests of the data sub¬≠ject or ano¬≠t¬≠her natu¬≠ral per¬≠son make pro¬≠ces¬≠sing of per¬≠so¬≠nal data necessa¬≠ry, Art. 6 (1) lit. d DSGVO ser¬≠ves as the legal basis.

If the processing is necessary to protect a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not override the former interest, Art. 6 (1) lit. f DSGVO serves as the legal basis for the processing.

Data deletion and storage period

The personal data of the data subject will be deleted or blocked as soon as the purpose of storage ceases to apply. In addition, storage may take place if this has been provided for by the European or national legislator in Union regulations, laws or other provisions to which the controller is subject. Data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or performance of a contract.

Passing on of data

Data is only passed on to third parties within the framework of legal requirements, i.e. e.g. on the basis of Art. 6 (1) lit. b DSGVO if this is necessary for contractual purposes or on the basis of Art. 6 (1) lit. f DSGVO due to legitimate interests.

If we use exter¬≠nal ser¬≠vice pro¬≠vi¬≠ders to pro¬≠vi¬≠de our ser¬≠vices, the¬≠se have been care¬≠ful¬≠ly selec¬≠ted and com¬≠mis¬≠sio¬≠ned by us. They are bound by our inst¬≠ruc¬≠tions and are regu¬≠lar¬≠ly moni¬≠to¬≠red. We take appro¬≠pria¬≠te legal pre¬≠cau¬≠ti¬≠ons as well as cor¬≠re¬≠spon¬≠ding tech¬≠ni¬≠cal and orga¬≠niz¬≠a¬≠tio¬≠nal mea¬≠su¬≠res to pro¬≠tect per¬≠so¬≠nal data.

A transfer of data to third countries in which the GDPR is not directly applicable law only takes place if there is an adequate level of data protection, user consent or otherwise legal permission.

Provision of the web¬≠site and crea¬≠ti¬≠on of log files
Description and scope of data processing

During the mere informational use of the website, i.e. if you do not register or otherwise transmit information to us, our system automatically collects data and information from the computer system of the calling computer.

The following data is collected in this context:

Information about the brow¬≠ser type and ver¬≠si¬≠on used.
The ope¬≠ra¬≠ting sys¬≠tem of the user
The user’s Internet service provider
The IP address of the user
Date and time of access
Time zone difference from Greenwich Mean Time (GMT)
Content of the request (spe¬≠ci¬≠fic page)
Amount of data trans¬≠fer¬≠red in each case
Websites from which the user’s system accesses our website
Websites that are accessed by the user’s system via our website

This data is also stored in the log files of our sys¬≠tem. This data is not stored tog¬≠e¬≠ther with other per¬≠so¬≠nal data of the user.

Legal basis for data processing

The legal basis for the tem¬≠pora¬≠ry sto¬≠rage of the data and the log files is Art. 6 para. 1 lit. f DSGVO.

Purpose of data processing

The temporary storage of the IP address by the system is necessary to enable delivery of the website to the user’s computer. For this purpose, the user’s IP address must remain stored for the duration of the session.

The storage in log files is done to ensure the functionality of the website. In addition, we use the data to optimize the website and to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context.

These pur¬≠po¬≠ses are also our legi¬≠ti¬≠ma¬≠te inte¬≠rest in data pro¬≠ces¬≠sing accord¬≠ing to Art. 6 Para. 1 lit. f DSGVO.

Duration of storage

The data is dele¬≠ted as soon as it is no lon¬≠ger requi¬≠red to achie¬≠ve the pur¬≠po¬≠se for which it was collec¬≠ted. In the case of the collec¬≠tion of data for the pro¬≠vi¬≠si¬≠on of the web¬≠site, this is the case when the respec¬≠ti¬≠ve ses¬≠si¬≠on has ended.

In the case of storage of data in log files, this is the case after seven days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are deleted or alienated, so that an assignment of the calling client is no longer possible.

Possibility of objection and removal

The collec¬≠tion of data for the pro¬≠vi¬≠si¬≠on of the web¬≠site and the sto¬≠rage of the data in log files is abso¬≠lute¬≠ly necessa¬≠ry for the ope¬≠ra¬≠ti¬≠on of the web¬≠site. Consequently, the¬≠re is no pos¬≠si¬≠bi¬≠li¬≠ty of objec¬≠tion on the part of the user.

Registration
Description and scope of data processing

On our website, we offer users the opportunity to register by providing personal data. The data is entered in an input mask and transmitted to us and stored. The data is not passed on to third parties. The following data is collected during the registration process:

E‚ÄĎmail address
First and last name
Company
Address, pos¬≠tal code and city
Country
State
Telephone number
Fax number
A free¬≠ly selec¬≠ta¬≠ble user name
A freely selectable password

As part of the registration process, the user’s consent to the processing of the data is obtained. At the time of registration, the following additional data is also stored:

The IP address of the user
Date and time of registration
Legal basis for data processing

The legal basis for the pro¬≠ces¬≠sing of the data pro¬≠vi¬≠ded by you is Art. 6 para. 1 lit. a DSGVO if the user has given his con¬≠sent. The legal basis for pro¬≠ces¬≠sing the data you have pro¬≠vi¬≠ded in accordance with com¬≠mer¬≠cial and tax law requi¬≠re¬≠ments is Art. 6 (1) lit. c DSGVO.

If the regis¬≠tra¬≠ti¬≠on ser¬≠ves the ful¬≠fill¬≠ment of a con¬≠tract to which the user is a par¬≠ty or the imple¬≠men¬≠ta¬≠ti¬≠on of pre-con¬≠¬≠trac¬≠¬≠tu¬≠al mea¬≠su¬≠res, the addi¬≠tio¬≠nal legal basis for the pro¬≠ces¬≠sing of the data is Art. 6 para. 1 lit. b DSGVO. The sto¬≠rage of the fur¬≠ther collec¬≠ted data is based on legi¬≠ti¬≠ma¬≠te inte¬≠rests accord¬≠ing to Art. 6 para. 1 lit. f DSGVO.

Purpose of data processing

User registration is required for the provision of certain content and services on our website. These include the possibility of ordering spectacle frames for registered dealers.

Duration of storage

The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. This is the case for the data collected during the registration process when the registration on our website is cancelled or modified.

Possibility of objection and removal

As a user, you have the opti¬≠on to can¬≠cel your regis¬≠tra¬≠ti¬≠on at any time. You can have the data stored about you chan¬≠ged at any time.

Contact form and e‚ÄĎmail contact
Description and scope of data processing

A con¬≠ta¬≠ct form is avail¬≠ab¬≠le on our web¬≠site, which can be used for elec¬≠tro¬≠nic con¬≠ta¬≠ct. If a user takes advan¬≠ta¬≠ge of this opti¬≠on, the data ent¬≠e¬≠red in the input mask is trans¬≠mit¬≠ted to us and stored. These data are:

Additional remarks to an order

For the processing of the data, your consent is obtained during the sending process and reference is made to this privacy policy.

At the time of sending the message, the following data is also stored:

The IP address of the user
Date and time of registration

Alternatively, it is pos¬≠si¬≠ble to con¬≠ta¬≠ct us via the e‚ÄĎmail address pro¬≠vi¬≠ded. In this case, the user‚Äôs per¬≠so¬≠nal data trans¬≠mit¬≠ted with the e‚ÄĎmail will be stored. In this con¬≠text, the data will not be pas¬≠sed on to third par¬≠ties. The data is used exclu¬≠si¬≠ve¬≠ly for pro¬≠ces¬≠sing the conversation.

Legal basis for data processing

The legal basis for the processing of data is Art. 6 para. 1 lit. a DSGVO if the user has given his consent.

The legal basis for the pro¬≠ces¬≠sing of data trans¬≠mit¬≠ted in the cour¬≠se of sen¬≠ding an e‚ÄĎmail is Art. 6 (1) lit. f DSGVO. If the con¬≠ta¬≠ct aims at the con¬≠clu¬≠si¬≠on of a con¬≠tract, the addi¬≠tio¬≠nal legal basis for the pro¬≠ces¬≠sing is Art. 6 para. 1 lit. b DSGVO.

The sto¬≠rage of the fur¬≠ther collec¬≠ted data is based on legi¬≠ti¬≠ma¬≠te inte¬≠rests accord¬≠ing to Art. 6 para. 1 lit. f DSGVO.

Purpose of the data processing

The pro¬≠ces¬≠sing of per¬≠so¬≠nal data from the input mask ser¬≠ves us sole¬≠ly to pro¬≠cess the con¬≠ta¬≠ct. In the case of con¬≠ta¬≠ct by e‚ÄĎmail, the necessa¬≠ry legi¬≠ti¬≠ma¬≠te inte¬≠rest in pro¬≠ces¬≠sing the data lies pre¬≠cise¬≠ly in the pro¬≠ces¬≠sing of the conversation.

The other per¬≠so¬≠nal data pro¬≠ces¬≠sed during the sen¬≠ding pro¬≠cess ser¬≠ve to pre¬≠vent misu¬≠se of the con¬≠ta¬≠ct form and to ensu¬≠re the secu¬≠ri¬≠ty of our infor¬≠ma¬≠ti¬≠on tech¬≠no¬≠lo¬≠gy sys¬≠tems. In the¬≠se pur¬≠po¬≠ses also lies the legi¬≠ti¬≠ma¬≠te inte¬≠rest in the data pro¬≠ces¬≠sing accord¬≠ing to Art. 6 para. 1 lit. f DSGVO.

Duration of storage

The data is dele¬≠ted as soon as it is no lon¬≠ger requi¬≠red to achie¬≠ve the pur¬≠po¬≠se for which it was collec¬≠ted. For the per¬≠so¬≠nal data from the input mask of the con¬≠ta¬≠ct form and tho¬≠se sent by e‚ÄĎmail, this is the case when the respec¬≠ti¬≠ve con¬≠ver¬≠sa¬≠ti¬≠on with the user has ended. The con¬≠ver¬≠sa¬≠ti¬≠on is ended when it is clear from the cir¬≠cum¬≠s¬≠tan¬≠ces that the mat¬≠ter in ques¬≠ti¬≠on has been con¬≠clu¬≠si¬≠ve¬≠ly clarified.

The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.

Possibility of objection and removal

The user has the pos¬≠si¬≠bi¬≠li¬≠ty to revo¬≠ke his con¬≠sent to the pro¬≠ces¬≠sing of per¬≠so¬≠nal data at any time. If the user con¬≠ta¬≠cts us by e‚ÄĎmail, he can object to the sto¬≠rage of his per¬≠so¬≠nal data at any time. In such a case, the con¬≠ver¬≠sa¬≠ti¬≠on can¬≠not be continued.

All per¬≠so¬≠nal data stored in the cour¬≠se of con¬≠ta¬≠c¬≠ting us will be dele¬≠ted in this case.

We process the data you provide to process your order. For this purpose, we may pass on your data to third party companies for the processing of payment and delivery. The terms and conditions and data protection information of those companies apply, which are listed in the order processing, in our information on payment and shipping or in the respective transaction applications that you go through during the payment process.

In the course of the online purchase, the following additional data is also stored:

The IP address of the user
The user

Legal basis for data processing

The legal basis for the processing of data is Art. 6 para. 1 lit. a DSGVO if the user has given his consent.

In the case of processing of personal data that is necessary for the performance of a contract, Art. 6 (1) lit. b DSGVO serves as the legal basis. This also applies to processing operations that are necessary for the implementation of pre-contractual measures.

A transfer of data to third parties takes place on the basis of Art. 6 para. 1 lit. f DSGVO because of legitimate interests to optimize our online offer.

The legal basis for pro¬≠ces¬≠sing the data you pro¬≠vi¬≠de in accordance with com¬≠mer¬≠cial and tax law requi¬≠re¬≠ments is Art. 6 (1) lit. c DSGVO.

The sto¬≠rage of the fur¬≠ther collec¬≠ted data is based on legi¬≠ti¬≠ma¬≠te inte¬≠rests accord¬≠ing to Art. 6 para. 1 lit. f DSGVO.

Purpose of data processing

Google uses your user profiles for the purposes of advertising, market research and/or demand-oriented design of its website. Such evaluation is carried out in particular (even for users who are not logged in) for the provision of needs-based advertising and to inform other users of the social network about your activities on our website.

By integrating Google Maps, we can show you interactive maps directly on the website and enable you to use the map function conveniently.

These pur¬≠po¬≠ses also con¬≠sti¬≠tu¬≠te the legi¬≠ti¬≠ma¬≠te inte¬≠rest in data pro¬≠ces¬≠sing accord¬≠ing to Art. 6 (1) lit. f DSGVO.

Duration of storage

We do not know the exact sto¬≠rage peri¬≠ods of the data. We have no infor¬≠ma¬≠ti¬≠on on the dele¬≠ti¬≠on of the collec¬≠ted data.

Possibility of objection and removal

If you do not wish your data trans¬≠mit¬≠ted to Google to be asso¬≠cia¬≠ted with your pro¬≠fi¬≠le at Google, you must log out befo¬≠re acti¬≠vat¬≠ing the but¬≠ton. You have the right to object to the crea¬≠ti¬≠on of user pro¬≠files, wher¬≠eby you must con¬≠ta¬≠ct Google to exer¬≠cise this.

For more information on the purpose and scope of data collection and processing by Google, please refer to Google’s privacy policy. There you will also find further information on your rights in this regard and setting options for protecting your privacy: https://www.google.de/intl/de/policies/privacy. Google also processes your personal data in the USA and has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.

Rights of the data subject

If personal data of yours is processed, you are a data subject within the meaning of the GDPR and you have the following rights against the controller:

Right of access

You may request confirmation from the controller as to whether personal data concerning you are being processed by us. If such processing is taking place, you may request information from the controller about the following:

The purposes for which the personal data are processed;
the categories of personal data which are processed;
the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed;
the planned duration of the storage of the personal data concerning you or, if concrete information on this is not possible, criteria for determining the storage period;
the existence of a right to rectification or erasure of the personal data concerning you, a right to restriction of processing by the controller or a right to object to such processing;
the existence of a right of appeal to a supervisory authority;
any available information on the origin of the data, if the personal data are not collected from the data subject;
the existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) of the GDPR and, at least in these cases, meaningful information about the logic involved and the scope and intended effects of such processing for the data subject.

You have the right to request information about whether the personal data concerning you are transferred to a third country or to an international organization. In this context, you may request to be informed about the appropriate safeguards pursuant to Art. 46 DSGVO in connection with the transfer.

This right of access may be limited to the extent that it is likely to render impossible or seriously impair the achievement of the research or statistical purposes and the limitation is necessary for the fulfillment of the research or statistical purposes.

Right to rectification

You have a right to rec¬≠ti¬≠fi¬≠ca¬≠ti¬≠on and/or com¬≠ple¬≠ti¬≠on vis-√†-vis the con¬≠trol¬≠ler if the per¬≠so¬≠nal data pro¬≠ces¬≠sed con¬≠cer¬≠ning you is inac¬≠cu¬≠ra¬≠te or incom¬≠ple¬≠te. The con¬≠trol¬≠ler shall make the rec¬≠ti¬≠fi¬≠ca¬≠ti¬≠on without undue delay.

Your right to rectification may be limited to the extent that it is likely to make impossible or seriously prejudice the achievement of the research or statistical purposes and the limitation is necessary for the fulfilment of the research or statistical purposes.

Right to restriction of processing

You may request the restriction of the processing of personal data concerning you under the following conditions:

if you con¬≠test the accu¬≠ra¬≠cy of the per¬≠so¬≠nal data con¬≠cer¬≠ning you for a peri¬≠od enab¬≠ling the con¬≠trol¬≠ler to veri¬≠fy the accu¬≠ra¬≠cy of the per¬≠so¬≠nal data;
the pro¬≠ces¬≠sing is unlaw¬≠ful and you object to the era¬≠su¬≠re of the per¬≠so¬≠nal data and request ins¬≠tead the restric¬≠tion of the use of the per¬≠so¬≠nal data;
the controller no longer needs the personal data for the purposes of processing, but you need them for the establishment, exercise or defense of legal claims; or
if you have objected to the processing pursuant to Article 21 (1) DSGVO and it is not yet clear whether the legitimate grounds of the controller outweigh your grounds.

If the pro¬≠ces¬≠sing of per¬≠so¬≠nal data con¬≠cer¬≠ning you has been restric¬≠ted, such data may ‚ÄĒ apart from being stored ‚ÄĒ only be pro¬≠ces¬≠sed with your con¬≠sent or for the asser¬≠ti¬≠on, exer¬≠cise or defen¬≠se of legal claims or for the pro¬≠tec¬≠tion of the rights of ano¬≠t¬≠her natu¬≠ral or legal per¬≠son or for rea¬≠sons of important public inte¬≠rest of the Union or a Member State.

If the restriction of processing has been restricted in accordance with the above conditions, you will be informed by the controller before the restriction is lifted.

Your right to restriction of processing may be limited to the extent that it is likely to render impossible or seriously impede the achievement of the research or statistical purposes and the restriction is necessary for the fulfilment of the research or statistical purposes.

Right to erasure

Obligation to delete

You may request the controller to erase the personal data concerning you without undue delay, and the controller is obliged to erase such data without undue delay, if one of the following reasons applies:

The personal data concerning you are no longer necessary for the purposes for which they were collected or otherwise processed.
You withdraw your consent on which the processing was based pursuant to Art. 6 (1) a or Art. 9 (2) a DSGVO and there is no other legal basis for the processing.
You object to the pro¬≠ces¬≠sing pur¬≠suant to Art. 21 (1) DSGVO and the¬≠re are no over¬≠ri¬≠ding legi¬≠ti¬≠ma¬≠te grounds for the pro¬≠ces¬≠sing, or you object to the pro¬≠ces¬≠sing pur¬≠suant to Art. 21 (2) DSGVO.
The personal data concerning you has been processed unlawfully.
The erasure of the personal data concerning you is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.
The per¬≠so¬≠nal data con¬≠cer¬≠ning you has been collec¬≠ted in rela¬≠ti¬≠on to infor¬≠ma¬≠ti¬≠on socie¬≠ty ser¬≠vices offe¬≠red pur¬≠suant to Article 8(1) of the GDPR.

If the con¬≠trol¬≠ler has made the per¬≠so¬≠nal data con¬≠cer¬≠ning you public and is obli¬≠ged to era¬≠se it pur¬≠suant to Article 17(1) of the GDPR, it shall take rea¬≠son¬≠ab¬≠le steps, inclu¬≠ding tech¬≠ni¬≠cal mea¬≠su¬≠res, having regard to the avail¬≠ab¬≠le tech¬≠no¬≠lo¬≠gy and the cost of imple¬≠men¬≠ta¬≠ti¬≠on, to inform data con¬≠trol¬≠lers that pro¬≠cess the per¬≠so¬≠nal data that you, as the data sub¬≠ject, have reques¬≠ted them to era¬≠se all links to or copies or repli¬≠ca¬≠ti¬≠ons of such per¬≠so¬≠nal data.

Exceptions

The right to erasure does not exist to the extent that the processing is necessary

For the exercise of the right to freedom of expression and information;
for compliance with a legal obligation which requires processing under Union or Member State law to which the controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
for rea¬≠sons of public inte¬≠rest in the area of public health pur¬≠suant to Art. 9(2)(h) and (i) and Art. 9(3) DSGVO;
for archi¬≠ving pur¬≠po¬≠ses in the public inte¬≠rest, sci¬≠en¬≠ti¬≠fic or his¬≠to¬≠ri¬≠cal rese¬≠arch pur¬≠po¬≠ses or sta¬≠tis¬≠ti¬≠cal pur¬≠po¬≠ses pur¬≠suant to Article 89(1) DSGVO, inso¬≠far as the right refer¬≠red to in sec¬≠tion a) is likely to ren¬≠der impos¬≠si¬≠ble or serious¬≠ly pre¬≠ju¬≠di¬≠ce the achie¬≠ve¬≠ment of the pur¬≠po¬≠ses of such pro¬≠ces¬≠sing; or
for the assertion, exercise or defense of legal claims.
Right to information

If you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to inform all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort.

You have the right vis-à-vis the controller to be informed about these recipients.

Right to data portability

You have the right to recei¬≠ve the per¬≠so¬≠nal data con¬≠cer¬≠ning you that you have pro¬≠vi¬≠ded to the con¬≠trol¬≠ler in a struc¬≠tu¬≠red, com¬≠mon and machi¬≠¬≠ne-rea¬≠d¬≠a¬≠¬≠ble for¬≠mat. You also have the right to trans¬≠fer this data to ano¬≠t¬≠her con¬≠trol¬≠ler without hin¬≠dran¬≠ce from the con¬≠trol¬≠ler to whom the per¬≠so¬≠nal data was pro¬≠vi¬≠ded, pro¬≠vi¬≠ded that

the pro¬≠ces¬≠sing is based on con¬≠sent pur¬≠suant to Art. 6 (1) a DSGVO or Art. 9 (2) a DSGVO or on a con¬≠tract pur¬≠suant to Art. 6 (1) b DSGVO and
the processing is carried out with the help of automated procedures.

In exer¬≠cis¬≠ing this right, you also have the right to obtain that the per¬≠so¬≠nal data con¬≠cer¬≠ning you be trans¬≠fer¬≠red direct¬≠ly from one con¬≠trol¬≠ler to ano¬≠t¬≠her con¬≠trol¬≠ler, inso¬≠far as this is tech¬≠ni¬≠cal¬≠ly fea¬≠si¬≠ble. Freedoms and rights of other per¬≠sons must not be affec¬≠ted by this.

The right to data portability does not apply to processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Right of objection

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Article 6(1)(e) or (f) DSGVO; this also applies to profiling based on these provisions. Data protection is a top priority at Berliner Platz.

The controller will no longer process the personal data concerning you unless it can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or for the establishment, exercise or defense of legal claims.

If the personal data concerning you is processed for the purposes of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purposes of such marketing; this also applies to profiling, insofar as it is related to such direct marketing.

If you object to the processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.

You have the pos¬≠si¬≠bi¬≠li¬≠ty, in con¬≠nec¬≠tion with the use of infor¬≠ma¬≠ti¬≠on socie¬≠ty ser¬≠vices ‚ÄĒ not¬≠with¬≠stan¬≠ding Directive 2002/58/EC ‚ÄĒ to exer¬≠cise your right to object by means of auto¬≠ma¬≠ted pro¬≠ce¬≠du¬≠res using tech¬≠ni¬≠cal specifications.

Right to revo¬≠ke your decla¬≠ra¬≠ti¬≠on of con¬≠sent under data pro¬≠tec¬≠tion law

You have the right to revoke your declaration of consent under data protection law at any time. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

Automated decision in individual cases including profiling

You have the right not to be sub¬≠ject to a decisi¬≠on based sole¬≠ly on auto¬≠ma¬≠ted pro¬≠ces¬≠sing ‚ÄĒ inclu¬≠ding pro¬≠filing ‚ÄĒ which pro¬≠du¬≠ces legal effects con¬≠cer¬≠ning you or simi¬≠lar¬≠ly signi¬≠fi¬≠cant¬≠ly affects you. This does not app¬≠ly if the decision

is necessary for the conclusion or performance of a contract between you and the controller,
is permitted by legal provisions of the Union or the Member States to which the controller is subject and these legal provisions contain appropriate measures to protect your rights and freedoms as well as your legitimate interests, or
is carried out with your explicit consent.

However, these decisions may not be based on special categories of personal data pursuant to Article 9(1) of the GDPR, unless Article 9(2)(a) or (g) applies and appropriate measures have been taken to protect the rights and freedoms and your legitimate interests.

With regard to the cases referred to in (1) and (3), the controller shall take reasonable steps to safeguard the rights and freedoms as well as your legitimate interests, including at least the right to obtain the intervention of a person on the part of the controller, to express his or her point of view and to contest the decision.

Right to complain to a supervisory authority

Without pre¬≠ju¬≠di¬≠ce to any other admi¬≠nis¬≠tra¬≠ti¬≠ve or judi¬≠cial reme¬≠dy, you have the right to lodge a com¬≠p¬≠laint with a super¬≠vi¬≠so¬≠ry aut¬≠ho¬≠ri¬≠ty, in par¬≠ti¬≠cu¬≠lar in the Member State of your resi¬≠dence, work¬≠place or the place of the alle¬≠ged infrin¬≠ge¬≠ment, if you con¬≠si¬≠der that the pro¬≠ces¬≠sing of per¬≠so¬≠nal data con¬≠cer¬≠ning you infrin¬≠ges the GDPR.

The super¬≠vi¬≠so¬≠ry aut¬≠ho¬≠ri¬≠ty to which the com¬≠p¬≠laint has been sub¬≠mit¬≠ted shall inform the com¬≠p¬≠lai¬≠nant of the sta¬≠tus and out¬≠co¬≠me of the com¬≠p¬≠laint, inclu¬≠ding the pos¬≠si¬≠bi¬≠li¬≠ty of a judi¬≠cial reme¬≠dy pur¬≠suant to Article 78 GDPR.
